TERMS AND CONDITIONS
Your privacy and security are important to us. Because
we gather certain types of information about Save U.S.
Pets Foundation (“Save U.S. Pets") users,
we feel you should fully understand the terms and conditions
surrounding the capture and use of that information.
This privacy statement discloses what information we
gather and how we use it. Questions regarding this
statement should be directed to lifesavingcare@saveuspets.org.
We amend this policy at any time by sending the amended
policy to any email address you provide to us, or by
posting the amended version on our home page. Under
no circumstances, however, would we change our privacy
policy in a way that would allow us to distribute your
personal information to third persons without your
approval. NOTE: Save U.S. Pets cannot accept information
from individuals who are under 18 years of age without
first obtaining express parental consent.
1. Capture and Use of Information.
Registration
If you participate in interactive activities (event
registration, message boards, membership program, etc.)
on Save U.S. Pets, you may be asked to register for
a free ID and password and/or to provide information
on event-registration forms. Unique identifiers, such
as IDs and passwords, are collected to verify your
identity and for use as account numbers in our record
system. Your contact information may also be used to
contact you when necessary for customer service reasons.
Financial information that is collected is used only
to bill you for products and services that you specifically
request.
IP Address
We may use your IP address to identify you and your
shopping cart, to administer our Web site and to assist
in diagnosing problems with our server.
2. Additional Uses of Information
All of the
information we collect, both what you tell us and what
we collect through the use of cookies, is used to personalize
your account, to customize our services and to allow
our customer service representatives to contact you
when necessary. Save U.S. Pets may use information
collected from you to tell you about programs or products
that may be of interest to you. It is Save U.S. Pets'
policy not to distribute to third parties any personally
identifying information about you without your consent
(usually communicated through an automatic “opt-in” mechanism
from which you can choose to "opt out").
In many cases, information will be released only on
an aggregated basis (meaning that the information from
many Save U.S. Pets users is grouped together in a
way that does not disclose the personal information
of any particular user). In other cases, we may use
contact information that you provide to send you information
about our company and promotional material from some
of our partners.
Special Note #1 for Users Accessing Save U.S. Pets
within a Frame
Save U.S. Pets has partnered with various web sites
("Framing Sites"), allowing users of those
Framing Sites to register for events and to otherwise
use the Save U.S. Pets services within a frame and
without leaving the Framing Site. In some cases, Save
U.S. Pets has agreed to provide to the Framing Site
personal information collected from people who make
use of the Save U.S. Pets services from the Framing
Site (that is, within a frame and without leaving the
Framing Site). In these cases, please be aware that
the Framing Site operates independently from, and may
have privacy and security policies wholly different
from, Save U.S. Pets. If you wish to make use of the
Save U.S. Pets services, but do not wish to have your
information shared with third parties, please access
our services directly, and not from a Framing Site.
Special Note #2 for Fulfillment Partners
In some cases, a third party with whom we have contracted
may need to coordinate, facilitate, or perform a
service for us (e.g., fulfill orders or other similar
activities). In these cases, Save U.S. Pets will
provide personal information to the third party.
Each such third party operates independently from,
and may have privacy and security policies wholly
different from, Save U.S. Pets. Save U.S. Pets bears
no responsibility for the activities of any third
party to whom Save U.S. Pets may provide fulfillment
information.
3. General Privacy Information.
You, the donor, acknowledge that all information furnished
by you under this donor agreement shall be held by
Save U.S. Pets in strict confidence and shall never
be reproduced, revealed or made accessible in whole
or in part, in any manner whatsoever,
to any other
persons unless required by law, or unless Save U.S.
Pets first obtains your express and written consent.
Save U.S. Pets further agrees that any and all donor
information will be requested only for the exclusive
use of Save U.S. Pets, and that Save U.S. Pets certifies
that any and all inquiries will be made only for such
donation and
related purposes.
The Save U.S. Pets web site contains links to partners,
advertisers and third party Internet sites and services
that may collect data in connection with registrations,
promotions, e-commerce, etc. Save U.S. Pets is also
linked to by, and in some cases framed by, certain
partner web sites. Each of the web sites (linked from
Save U.S. Pets, or linking to Save U.S. Pets) have
separate privacy and data collection practices, independent
of Save U.S. Pets, and Save U.S. Pets has no responsibility
or liability for these independent policies or actions
and is not responsible for the privacy practices or
the content of such Web sites.
4. Security.
Save U.S. Pets, through its website hosting vendors,
GoDaddy and The Active Network, maintains reasonable
security procedures to protect the confidentiality,
security and integrity of your personally identifiable
information. The vendors use a variety of industry-standard
security measures to maintain the safety of your personal
information. For example, credit card numbers are encrypted
in the Active Network secure database, which is located
behind a firewall. Personal information and such encrypted
credit card numbers collected on Save U.S. Pets are
stored in a secure operating environment that is not
available to the public. All credit card and registration
information supplied by users is transmitted via Secure
Socket Layer (SSL) technology. The Active Network’s
technology department conducts frequent site-security
audits. "Perfect security," however, does
not exist on the Internet. Although your privacy is
very important to us, due to the existing legal regulatory
and security environment, we cannot fully ensure that
your private communications and other personally identifiable
information will not be disclosed to third parties.
For example, Save U.S. Pets will disclose personal
information about an individual user if we believe
in good faith that such disclosure is necessary to
comply with an applicable law or valid legal process.
5. Protecting Yourself.
You, the donor, agree that Save U.S. Pets will not
be liable for consequential damages, even if advised
of the possibility of such damages. You also agree
that Save U.S. Pets’ aggregate liability, if
any, for any and all losses or injuries to you arising
out of any acts or omissions of Save U.S. Pets in connection
with anything to be done or furnished resulting from
this donor agreement, regardless of the cause of the
loss or injury and regardless of the nature of the
legal or equitable right claimed to have been violated,
shall never exceed the amount paid by you in your donation
under and pursuant to this donor agreement."
